A trust may help with transferring property after death and managing assets during incapacity, but those benefits do not create blanket immunity from debts or claims.

This distinction is important when your home is a major part of your family’s finances. Before treating a trust as protection from lawsuits or collection, understand what you keep control over and what the trust is designed to accomplish.

This article expands on the Wealth Crafters video Can a Revocable Living Trust Protect Me Against Creditors.

Why keeping control matters

A revocable trust generally lets its creator retain the ability to change or revoke the arrangement, subject to its terms and applicable law. The person creating the trust is often called the settlor or trustor. That person may also serve as trustee and use the trust property for their own benefit.

California Probate Code section 18200 addresses the creditor consequence directly: during the settlor’s lifetime, trust property is subject to the settlor’s creditors to the extent of the retained power of revocation. See section 18200 on the Legislature’s website and the statutory text reproduced by Justia.

Changing the name on the deed to reflect a revocable trust does not, by itself, erase that rule. The Orange County Superior Court’s living trust guide likewise explains that a living trust does not shelter its creator from creditors.

Probate avoidance and creditor claims are separate questions

Probate is a court process for administering a deceased person’s estate. A properly funded living trust can generally allow assets it holds to pass to beneficiaries without that probate process. It can also identify a successor trustee to manage trust assets when needed. These are important planning functions. The court’s overview of living trusts describes both.

Creditor claims concern whether someone has an enforceable right to payment. Avoiding probate for an asset does not establish that no debt can be paid from it. A family should therefore avoid assuming that “outside probate” means “outside all creditor claims.”

The same distinction helps set expectations for a successor trustee. Trust administration can involve records, expenses, debts, and distribution decisions even when a probate proceeding is unnecessary. A trust does not mean there is nothing left to administer.

Debts can still matter after death

California Probate Code section 19001 generally makes property that remained revocable at the settlor’s death available for specified creditor claims and probate administration expenses when the probate estate is insufficient to satisfy them. See section 19001 on the Legislature’s website and the reproduced statutory text.

That does not mean every demand is valid, every asset must be sold, or every beneficiary becomes personally responsible for every debt. The particular claim, property, procedures, and applicable law still matter. The Orange County court’s trust guidance discusses creditor claims and trust administration, including circumstances in which trust property may be used to pay claims.

For planning purposes, the useful conclusion is straightforward: do not promise your family that the trust automatically eliminates debts when you die.

A simple homeowner example

Imagine a homeowner who transfers a house into a revocable living trust and continues controlling the trust. The homeowner assumes the new deed prevents anyone with a valid claim against them from reaching the property.

The trust’s revocable status alone does not support that assumption. Whether a particular creditor can collect, and from what property, requires a separate analysis. The trust may still serve the homeowner’s inheritance and management goals; it simply should not be credited with protection it does not automatically provide.

This is a hypothetical illustration, not a description of a Wealth Crafters client or a prediction about a particular claim.

Other protections require their own review

California law recognizes exemptions that can matter to collection. Section 18201 preserves applicable exemptions for a settlor whose trust property is subject to claims under section 18200. This is a separate legal protection, not a new shield created merely by using a revocable trust. See California Probate Code section 18201.

Likewise, protections sometimes associated with a beneficiary’s interest in a trust should not be confused with protection against the creator’s own creditors. The court distinguishes these situations. The word “trust” alone is not enough to evaluate the result.

Questions to organize before your next conversation

Use a short list to separate your goals from assumptions:

Am I primarily trying to plan inheritance, prepare for incapacity, or understand exposure to claims?

Is my home actually held in the trust, and where is the recorded deed?

Which assets remain outside the trust?

Who would take over management, and where are the records they would need?

What mortgages, other debts, or existing claims should be included in the discussion?

Have I been relying on an unsupported promise that a trust makes everything protected?

Keep passwords and full account numbers off a general discussion sheet. Summaries can help you organize questions without unnecessarily sharing sensitive details.

Start with accurate expectations

A revocable living trust can support an estate plan without being a blanket creditor-protection strategy. Understanding that limit helps you ask better questions and explain the plan more accurately to your family.

For an informational consultation with Wealth Crafters, Inc., schedule a conversation or call 909-259-8242 Ext. 101.

This article is general education, not legal advice.
